1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of the website located at www.jspropertymaintenance.ca (the "Website") and your engagement with the services provided by JS Property Maintenance ("Company," "we," "us," or "our"). By accessing our Website, submitting a quote request, or engaging our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our Website or engage our services. These Terms apply to all visitors, leads, and customers, whether located in Quebec, Ontario, or any other jurisdiction.

These Terms should be read together with our Privacy Policy, which is incorporated herein by reference.

2. Services Offered

JS Property Maintenance provides residential lawn care and pest control services in Aylmer, Hull, Gatineau, and surrounding areas of the Outaouais region (Quebec and Ontario). Our current service offerings include:

All services are subject to availability, weather conditions, and property suitability. We reserve the right to modify, discontinue, or expand our service offerings at any time without prior notice.

3. Quotes, Bookings, and Service Agreements

3.1 Free Quotes

Quotes provided by JS Property Maintenance are free of charge and non-binding until accepted in writing or verbally confirmed by both parties. Quotes are based on the information provided by the customer and are subject to change following an on-site assessment.

3.2 Service Agreement

A service agreement is formed when you accept a quote and authorize us to proceed with service. By accepting a quote, you confirm that you are the property owner or have the legal authority to authorize services on the property. You agree to provide accurate information about your property, including its size, condition, and any known hazards.

3.3 Program Commitments

Certain lawn care programs involve multiple scheduled applications throughout the season. By enrolling in a program, you agree to the full program schedule as outlined in your service agreement. Individual applications within a program are not available on a standalone basis unless otherwise agreed in writing.

4. Pricing and Payment

Pricing for all services is determined based on property size, service type, and program selected. All prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes (GST/HST and QST where applicable).

  • Payment terms will be specified in your service agreement or invoice.
  • We accept payment by credit card, e-transfer, and other methods as communicated at the time of service.
  • Invoices are due upon receipt unless otherwise agreed in writing.
  • Overdue accounts may be subject to a late payment fee of 1.5% per month (18% per annum) on the outstanding balance.
  • We reserve the right to suspend or cancel services for accounts with outstanding balances.

5. Cancellation and Rescheduling

5.1 Customer Cancellations

You may cancel a scheduled service appointment with at least 24 hours' notice at no charge. Cancellations with less than 24 hours' notice may be subject to a cancellation fee as specified in your service agreement. Cancellation of a full program after services have commenced may result in charges for services already rendered, calculated on a per-application basis.

5.2 Company Cancellations

We reserve the right to reschedule or cancel service appointments due to weather conditions, equipment issues, staff availability, or other circumstances beyond our control. In such cases, we will notify you as soon as reasonably possible and reschedule at no additional charge.

5.3 Weather-Related Delays

Lawn care and pest control services may be affected by weather conditions. We will make reasonable efforts to reschedule services affected by weather within a reasonable timeframe. No refunds will be issued for weather-related delays where services are rescheduled.

6. Service Expectations and Customer Responsibilities

To ensure the safe and effective delivery of our services, you agree to the following responsibilities:

  • Ensure that the service area is accessible on the scheduled service date (unlocked gates, cleared pathways, etc.).
  • Remove pets, children, and sensitive items from the service area prior to and during service.
  • For pest control treatments, keep people and pets off treated areas for the time period specified by our technician (typically 30–60 minutes after application, or until dry).
  • Notify us of any known allergies, sensitivities, or medical conditions that may be relevant to the products we use.
  • Notify us of any underground utilities, irrigation systems, or other features that could be affected by our services.
  • Water the lawn as directed following fertilizer applications to maximize effectiveness.
  • Provide accurate information about your property and any previous treatments applied.

Failure to fulfill these responsibilities may affect the quality of service and may limit our liability for any resulting issues.

7. Service Results and No Guarantee of Outcome

While we strive to deliver the best possible results, lawn care and pest control outcomes are influenced by many factors outside our control, including but not limited to: soil conditions, weather, existing lawn health, pest pressure levels, property drainage, and customer compliance with post-service instructions.

We do not guarantee specific results such as complete weed elimination, total pest eradication, or a specific level of lawn improvement. Our programs are designed to provide meaningful improvement over time with consistent application. Results may vary by property.

If you are not satisfied with the results of a service, please contact us within 7 days of the service date. We will assess the situation and, at our discretion, re-apply the service or provide a credit toward future services.

8. Limitation of Liability

To the fullest extent permitted by applicable law, JS Property Maintenance's total liability to you for any claim arising from or related to our services or these Terms shall not exceed the amount paid by you for the specific service giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, property damage not directly caused by our negligence, or damages resulting from your failure to follow post-service instructions.

We maintain general liability insurance appropriate for our industry. Proof of insurance is available upon request.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Communications Consent

By submitting a quote request form on our Website, you expressly consent to be contacted by JS Property Maintenance through the following channels for the purposes described:

Phone CallsWe may call you to discuss your service inquiry, provide quotes, schedule appointments, and follow up on services rendered.
SMS / Text MessagesWe may send you text messages (SMS) for appointment reminders, service updates, and follow-up communications. Standard message and data rates may apply. Reply STOP at any time to opt out of SMS communications.
EmailWe may send you emails for quotes, invoices, service confirmations, and — with your express consent — promotional communications about our services and seasonal offers. You may unsubscribe at any time using the link in any email.

This consent is provided in compliance with Canada's Anti-Spam Legislation (CASL) and applicable provincial communications laws. You may withdraw your consent for marketing communications at any time without affecting the validity of your service agreement or our ability to send transactional messages.

We will not contact you using automated dialing systems or pre-recorded messages without your prior express written consent, in compliance with applicable Canadian telecommunications regulations.

10. Digital Advertising and Tracking

Our Website uses digital advertising tools, including the Meta Pixel (Facebook/Instagram), to measure the effectiveness of our advertising campaigns and to deliver relevant advertisements to users who have visited our Website or submitted a form.

By using our Website, you acknowledge that:

  • We may use cookies and tracking pixels to collect information about your visit for advertising purposes.
  • We may share hashed (encrypted) contact information with Meta Platforms to create Custom Audiences for targeted advertising, in compliance with Meta's Business Tools Terms.

11. Intellectual Property

All content on our Website, including but not limited to text, images, logos, graphics, and service descriptions, is the property of JS Property Maintenance and is protected by applicable Canadian copyright and intellectual property laws. You may not reproduce, distribute, or use any content from our Website without our prior written consent.

12. Acceptable Use of Website

You agree to use our Website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Submit false, misleading, or fraudulent information through our forms
  • Attempt to gain unauthorized access to any part of our Website or systems
  • Use our Website to transmit spam, malware, or other harmful content
  • Scrape, copy, or reproduce our Website content without authorization

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. For customers in Ontario, applicable Ontario and federal laws will apply to the extent they differ from Quebec law.

Any dispute arising from these Terms or our services shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, disputes may be submitted to mediation or, if necessary, to the courts of competent jurisdiction in the Province of Quebec or Ontario, as applicable.

Nothing in these Terms limits your rights under applicable consumer protection legislation in Quebec (including the Consumer Protection Act) or Ontario (including the Consumer Protection Act, 2002).

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our Website with an updated "Last Updated" date. Your continued use of our Website or services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
